Z9 Monitor – End User License Agreement

Z9 Systems ("we") licenses the Z9 Monitor software ("Software") to the organisation installing it ("you"). By installing or using the Software you agree to these terms.

1. License

Subject to payment of the applicable fees (or during a trial), we grant you a non-exclusive, non-transferable license to install and use the Software on one server for your internal business purposes, up to the number of monitored items and for the edition and period stated in your license file. Items beyond the licensed number are not monitored. A trial is for evaluation only: one trial of 14 days per organisation. The trial must be activated by connecting once to the Z9 license service within 3 days of installation (servers without internet access can ask us for an offline trial license). A new installation on the same machine or in the same Windows domain continues the earlier trial instead of starting a new one; we may end or extend a trial at our discretion.

2. Restrictions

You may not (a) copy, resell, sublicense, rent or lend the Software; (b) reverse engineer, decompile or disassemble it, or circumvent its license checks, except where applicable law expressly permits this despite this restriction; (c) remove copyright or proprietary notices; (d) use it to provide services to third parties unless your license allows it.

3. Your data

All data collected by the Software stays on your server. The Software contacts the Z9 license service only to activate and verify the license and to check for updates; it sends the license ID, installation ID, version, the number of monitored items, the computer name and Windows domain of the server on which the Software runs and the company name entered in its settings (so that we can tell our customers apart); to recognise repeated trials we also keep a one-way hash of the public IP address the connection comes from, not the address itself – never the names, IP addresses, credentials or monitoring data of the servers it monitors. If you fill in the first step of the quick setup ("Your company"), the Software also sends the company name, contact name and e-mail address entered there to register your trial, so that we can support you and send your license; if you skip that step, none of these details are sent. We use these details only to contact you about Z9 Systems products and you can ask us to delete them at any time. See also our privacy notice.

4. Third-party components

The Software includes open-source components (Python, InfluxDB and others) under their own licenses, listed in THIRD-PARTY-NOTICES.txt. Nothing in this agreement limits your rights under those licenses.

5. Maintenance

Updates and support are provided while your maintenance period is active. Perpetual licenses keep working after maintenance ends; updates released afterwards require renewing maintenance.

6. Warranty

The Software is provided "as is". We do not warrant that it is error-free or that it will detect every failure of your systems. It is a monitoring aid and does not replace your own backup, security and operating procedures.

7. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, loss of data, profits or business. Our total liability is limited to the fees you paid for the Software in the twelve months before the claim.

8. Termination

The license ends automatically if you breach these terms. On termination you must stop using the Software and remove it.

9. Governing law

This agreement is governed by the laws of Malaysia.
